Attorney Jon Pope, a partner at Hasty Pope, LLP, recently presented a seminar on damages for frivolous claims or defense at the 18th Annual General Practice and Trial Institute, presented by the Institute of Continuing Legal Education (ICLE). The seminar, titled Damages Under O.C.G.A. § 9-11-68(E), covered frivolous claims or defense, including what they are and how to pursue damages for them under 9-11-68(E).
According to the presentation, a frivolous claim or defense is one that “lacks substantial justification, [is] not made in good faith, or [is] made with malice/bad purpose.” Damages for a frivolous claim or defense may also be sought when there is an “absence of justiciable issue of law or fact such that it couldn’t be reasonably believed the Court would accept” or in the event of “delay or harassment.”
During the seminar, Jon Pope covered pre-trial considerations, the issue of voir dire, and how to argue these types of cases at trial.
