Auto Accidents

Auto Accident - $2,500,000 Settlement

On September 23, 2003, at the intersection of Tamarind and Fern in the city of West Palm Beach, Florida, the plaintiff was struck by the defendant's vehicle while operating her Buick sedan. The collision occurred as a result of the defendant unlawfully trespassing into the intersection on a red traffic signal.

The collision resulted in severe injuries to the plaintiff, including a head injury, shock, multiple rib fractures and a collapsed left lung. It was also discovered during exploratory surgery that the plaintiff had suffered a lacerated liver and spleen, a fractured left femur, and multiple pelvic fractures.

Auto Accident - $300,000 Settlement

The plaintiff, as well as his wife and daughter-in-law, were traveling north-bound on Veterans Memorial Boulevard in Forsyth County, Georgia when they were struck by a vehicle driving in the opposite direction that had crossed over the median. The head-on collision resulted in severe injuries to the plaintiff, his wife, and his daughter-in-law, including lacerations, numerous fractures, and hematomas.

All three victims were transported to the North Fulton Regional Medical Center where they received extensive medical care to treat their injuries. The medical expenses were considerable, and the plaintiff's were unable to work while they were recovering from their injuries. Auto Accident - $275,000 Settlement

At approximately 6:25 p.m. one evening, the plaintiff was traveling in her vehicle west bound on Knox Bridge road near Fields Chapel road when the defendant driver approached her vehicle proceeding east bound in excess of the posted speed limit, went wide in the curve and left the road.  The defendant jerked the wheel of his vehicle to the left causing the vehicle to enter the west bound lane, yaw to its side and to the right and strike the plaintiff’s vehicle head-on in the far west bound lane.  The plaintiff sustained multiple skull fractures, a gash on her forehead, a broken left eye orbit, double vision, a broken nose, five broken ribs, and her heel broken in two places.

Auto Accident - $250,000 Settlement

The plaintiff was traveling west-bound on Highway 20 towards Pruitt Road. The defendant was traveling east-bound on Highway 20, negotiating the same curve. The defendant was driving a tractor trailer loaded with a car-carrying trailer. Upon encountering stopped traffic, the defendant found he was unable to stop his tractor-trailer in time, and as a result, locked his brakes and jack-knifed into the west-bound lane of traffic, where his vehicle struck the plaintiff's. A vehicle that was being transported on the top of the trailer came loose from its tie-downs and landed on top of the plaintiff's vehicle.

The plaintiff was transported to the North Fulton Regional Hospital where she was diagnosed with a compression of the L1 vertebral body, multiple fractures in the foot and ankle, and a right non-displaced patellar fracture. She required extensive surgery and rehabilitation to treat her injuries. Our attorneys demonstrated that the collision was a result of the defendant's reckless and negligent actions.

Auto Accident - $175,000 Settlement

The plaintiff was at an intersection in her 1988 Honda Civic when she was rear-ended by the defendant. The investigating officer cited the defendant with driving too fast for the wet road conditions. As a result of the rear-end collision, the plaintiff sustained injuries to her lower back which required medical care and rehabilitation.

Auto Accident - $160,000 Settlement

The plaintiffs were traveling together as they approached a curve in the road. The Defendant was traveling well in excess of the speed limit when he entered a curve traveling in the opposite direction.  Realizing he would be unable to maneuver the curve, the defendant locked up the front brakes and skidded 124 feet, crossed the centerline and impacted our clients head on, resulting in significant injuries.  Citations were issued to the Defendant at the scene of the accident for: Reckless Driving; No Proof of Insurance; and Failure to Maintain Lane. The Defendant plead guilty to all of these charges.

Auto Accident - $100,000 Jury Verdict

The plaintiff was driving when she was rear-ended by the defendant, who was cited with following too closely. The plaintiff sought immediate medical treatment for headache and neck pain. She was diagnosed with post head injury syndrome. She was treated with medication but was subsequently diagnosed with depression and cognitive impairment.  Upon receiving further medical care, it was determined that the plaintiff suffered a cervical radiculitis that was not responsive to epidural steroid injections and a severe bi-frontal headache.

Auto Accident - $100,000 Settlement

The plaintiff was riding as a passenger, and was stopped at an intersection in Marietta, Georgia. The driver was yielding the right of way to an ambulance with its emergency equipment activated. The defendant failed to stop with traffic and violently hit the back of vehicle which the plaintiff was riding in. The defendant, who was driving a full-sized SUV, was given a warning for following too closely.

Conservative treatments failed to help the plaintiff, and he was diagnosed with a compression fracture at L1-2 vertebrae. After the plaintiff underwent a thoracic and lumbar MRI, he was also diagnosed with disc bulges at C4-5 and C5-6. The plaintiff required extensive physical therapy.

Auto Accident - $100,000 Jury Verdict

Traveling North on SR 124 near Norris Lake Road, our client stopped due to traffic, and as a result of following too closely, the defendant rear ended the plaintiff's vehicle. The client immediately began experiencing pain in her neck due to the accident and this was noted on the accident report.  The client was treated at Gwinnett Clinic by Meena J. Shah & Associates for headaches and neck pain. She was ultimately directed to proper treatment with a neurologist, and treated for Post Concussive Syndrome.  She was placed in appropriate therapy.

Auto Accident - $100,000 Settlement

The plaintiff was rear ended at an intersection and immediately transported to the emergency department at Gwinnett Medical Center. It is noted in the records that the plaintiff had complaints of chest wall pain, right knee pain, and lacerations to the right knee. X-rays were taken which confirmed the plaintiff had multiple comminuted fractures of the patella. She was diagnosed with a left finger contusion, a right knee sprain, a comminuted open fracture of the right knee and lacerations of the right knee.  She was instructed not to work for 5 days and to follow-up with an orthopedic physician.

She was treated at Resurgens Orthopaedics in Roswell, where X-rays showed a significant right patella fracture. After discussing possible treatment plans, our client underwent surgery at North Fulton Regional Hospital. During the procedure three major fractures and four smaller fractures were found. Following the surgery, the orthopedic physician instructed our client to continue with the knee immobilize treatment for three (3) more weeks and follow-up for another knee x-ray and further clinical evaluation.  During the follow-up on December 21, 2004, more x-rays were taken and another physician at Resurgens recommended rehabilitation and scheduled a future appointment. The client began therapy at Jasper Physical Therapy, where her orthopedic physician discontinued therapy due to lack of progress. A second surgery was performed, which proved successful.

Professional Negligence and Auto Accident – Undisclosed Amount

In this case, the plaintiff's son (a minor) was riding as a passenger in a sedan with three of his friends. All four occupants were properly restrained and subsequent toxicology reports demonstrated that none of the teenage occupants had been under the influence of drugs or alcohol. On the evening of September 1, the Mercedes sedan that the plaintiff's son was riding in as a passenger was involved in a collision that resulted in the death of all four occupants.

It was later shown that the collision was caused by the negligent actions of the defendants. Three of the four tires on the car barely met or failed to meet the minimum required tread depth in the state of Georgia. Earlier in the day, the owner of the Mercedes sedan had taken the car in for a safety inspection and four-wheel alignment, during which, the defendant failed to recognize or report on the dangerously low tread depth. That evening, the unsafe tires caused the car to hydroplane and lose control. It was then struck by the co-defendant, who was driving while under the influence of alcohol.

Auto Accident - $75,000 Settlement

The plaintiff was involved in a rear end collision and was originally seen by Northside Medical Specialists. Our clients had complaints of back and neck pain, and X-rays of the spine were ordered and taken at Northside Hospital Cherokee. The drugs Voltaren, Skelaxin, and Percocet were prescribed for pain. The plaintiff continued to have pain and began to have headaches shortly after the accident. Our client began treatment at Superior Healthcare and continued treatment at this facility which included physical therapy and trigger point injections. Soon thereafter the client was referred to Resurgens Orthopaedics. Our client reached Maximum Medical Improvement.

Auto Accident - $50,000 Settlement

The plaintiff was injured when her vehicle was rear-ended by a vehicle operated by an employee of a major pest control company. She suffered thoracic outlet syndrome of the shoulder as a result of the collision that required $20,000 in medical expenses.

Auto Accident - $50,000 Settlement

In this case, the plaintiff was driving her vehicle when the defendant attempted to make a left hand turn onto the roadway from a private driveway. The defendant failed to yield the right of way to the plaintiff and made an illegal left-hand turn, causing the two vehicles to collide. The defendant suffered a torn rotator cuff and injuries to the neck and back.

Wrongful Death

Wrongful Death - $1,000,000 Verdict Amount

The plaintiff, who was 42 years old at the time, passed away from respiratory depression as a result of being prescribed Methadone by the defendant. It was found that the defendant's change of prescription medication for the victim from OxyContin to Methadone constituted a failure by the defendant to abide by the Standard of Care because the two medications were not equianalgesic. The buildup of Methadone in the body eventually caused respiratory depression that caused the victim's death. The lawsuit was later settled for an undisclosed amount.

Wrongful Death - $200,000 Settlement

The plaintiff was admitted to a rehabilitation center on February 27, 2004, for a stay that was supposed to last roughly two weeks. The plaintiff suffered from numerous medical conditions that required she have constant medical care.

Upon her admittance, the plaintiff was categorized as a low fall risk, but on March 5, 2004, she slipped from her wheelchair while reaching for an item she had dropped and struck the ground. At the time, the nurse indicated that the resident had not suffered any injuries. No precautions were taken to prevent such an accident from occurring again. On March 8, 2004, at approximately 11:00 AM, a visitor alerted the staff that the plaintiff had fallen out of her wheelchair and was lying on the ground.

The plaintiff was rushed to the emergency room at the Northeast Georgia Medical Center where she was diagnosed with cranial bleeding. The plaintiff underwent surgery to relieve the cranial bleeding, but suffered a re-bleeding into the ventricles. She died on March 14, 2004. It was later shown that the plaintiff suffered injuries as a result of the nursing home facility staff's failure to meet the Standard of Care, and those injuries eventually caused her death.

Medical Malpractice

Medical Malpractice – Undisclosed Amount

In this case, the defendant failed to meet the minimum Standard of Care while treating his patient, the plaintiff. The defendant failed to outline a plan of care for the plaintiff, who had a history of Thyoma, and failed to acquire and analyze results from an X-ray taken of the plaintiff on March 9, 2000. The results of the x-ray test taken on March 9 indicated a left anterior chest mass roughly 14 X 7cm that was secondary to recurrent Thyoma. The results of the test were not made aware to the plaintiff by the defendant until March 23, after the plaintiff had collapsed at work and been rushed to the emergency care center. By this time, the mass had already grown to 15 X 9.8 X 10.3cm, and invaded the plaintiff's left lung and pulmonary artery.

Medical Malpractice – Undisclosed Amount

The plaintiff went to a pharmacy in Canton, Georgia, to have various prescriptions filled. She was prescribed 0.5-milligram pills of the generic drug Clonazepam (brand name Klonopin) for her restless legs and Omeprazole (Prilosec) for her ulcer. Instead of filling the pill bottle with 0.5-milligram pills of Clonazepam, the pharmacist filled the pill bottle with 1 milligram pills, thus doubling her dosage of the drug. In addition, the label on the pill bottle incorrectly indicated that it contained 0.5-milligram pills. Instead of filling the second bottle with Prilosec, the defendant filled the bottle with the medication known by the brand name Paxil (generic name Paroxetine Hydrochloride). As a result of ingesting the incorrect dosage and medicine, the plaintiff lost consciousness and fell, fracturing her hip and tearing her right knee.

Workers' Compensation

Workers' Compensation and Personal Injury - $490,000 Settlement

The plaintiff fell 25 feet from an outdoors billboard sign as a result of electrical shock. The sign was placed negligently within 5'2" of an electrical power line by the defendant. The electrical shock entered through the plaintiff's body when his equipment inadvertently came into contact with the power line. The plaintiff suffered severe injuries, including respiratory failure, cardiac arrest, a fractured right wrist, and damaged spleen and lung. The plaintiff currently suffers from short term memory loss and learning impairments that limit his ability to earn wages.

Workers’ Compensation - $120,000 plus medical expenses for life

The claimant was originally seen at Oconee Regional Medical Center, in the emergency room, after falling from a bulldozer while working at a drilling company.  He underwent several diagnostic tests that determined he had an open tibia/fibula fracture, abdominal pain and a possible spleen hematoma as well as small pneumothorax and small hemothorax to the left lung.  A chest tube was placed into the left side of the lung.  As a result of the lengthy surgery required to repair the tibia fracture, the claimant developed an infection in his leg.  Several diagnostic tests were performed to determine the type of infection that the plaintiff contracted.  It was later determined that our client had contracted Methicillin resistant Staphylococcus.  After several repeat surgeries, his medical condition stabilized.

Workers’ Compensation - $95,000 Settlement

             
Our client was an employee of a supermarket who fell on the job, injuring her left knee and left wrist.  After an MRI and other diagnostic testing on her left wrist, it was determined that she required both left knee surgery and left wrist surgery.  Workers’ Compensation insurance paid for all the required surgeries, plus weekly lost wages during the time the claimant was out of work.  The orthopedic surgeon determined that it was more likely than not that the claimant would develop problems with her opposite knee from overuse syndrome and outlined a plan of future care.

Workers’ Compensation - $80,000.00 Settlement

The claimant was a state patrol officer who seriously injured her back and neck while pulling a sand dummy during police training.  She was treated by the authorized treating physician for her injuries.  As she continued her treatment with the doctor, she was diagnosed with degenerative disc disorder with chronic pain, spasms and fibromyalgia.  In addition to these problems, the doctor further diagnosed her with chronic lumbar facet syndrome and sciatica.  Each of these diagnoses was related to her work accident.  The claimant was on light duty doing paperwork and had been precluded from any physical activity including any physical performance testing.  Additionally, two employer-requested Independent Medical Examinations confirmed our client's multiple diagnoses.  In addition to reaching a settlement with Workers’ Compensation, Hasty Pope assisted in recovering over $50,000.00 in Social Security Disability payments for the client.

Workers’ Compensation - $80,000 Settlement

The claimant was a 54 year old female who had a reported four (4) year history of complex regional pain syndrome of the left upper extremity. Our client was a horticulturist for a wholesale nursery in Woodstock. This pain syndrome originated with a fall resulting in a fracture of her radius just above her wrist at the distal 1/3 of the bone.  She was initially treated by an orthopedic surgeon, and wore a cast for approximately five (5) weeks. When the cast was removed she continued to experience pain and extensive swelling. She began to experience hyperesthesia which radiated along her left extremity causing numbness. She had an EMG nerve conduction study which revealed carpal tunnel syndrome in February of 1997, and she had an open carpal tunnel decompression at that time. After the surgery had been completed, she continued to have numbness and touch sensitivity. In March of 1997 she had a DeQuervain’s decompression with no noticeable improvement. After experiencing chronic depression and anxiety secondary to her work-related injury, her doctor determined that she would not be able to return to work.

Other Results

Destruction of Property - $262,000 Jury Verdict

The plaintiff owns approximately 94 acres in Cherokee County, Georgia, with part of the property bordering the Etowah River. The defendant has a rail line that passes through the plaintiff's property over the Etowah River, via a trestle. Between 1991 and the present, the defendant allowed debris, trees, shrubbery and brush to build up along the upstream side of the trestle. As a result, the natural flow of the river was altered, which subsequently eroded over 500,000 cubic feet of dirt from the plaintiff's property into the Etowah River. The plaintiff filed for damages relating to the destruction of his property by the defendant.

Negligence and Fraud - $52,000 Settlement

The plaintiffs purchased a home from the defendant that had been treated and covered under a pest treatment contract with an extermination company, the co-defendant. When the defendant sold the home to the plaintiffs, a fraudulent letter was prepared by the co-defendant that omitted any mention of a previous termite infestation.
