What Is Eminent Domain?

Eminent domain refers to the government's ability to appropriate, or take over, any private property within its jurisdiction without the owner's consent. This power is typically used so that the property can be reallocated to public use, though "public use" can be broadly interpreted by the government. In some cases, states have exercised their eminent domain rights for projects that allocated the land to private entities under the guise of "economic redevelopment."

The eminent domain process requires that the government first try to negotiate a sale with the property owner.
